Provide legal advice to all levels of managementin Yum! for franchised markets in Latin America and Caribbean (LA&C) regionincluding managing and preparing documentation relating to all aspects offranchising and implementing and monitoring legal compliance programmes,managing franchise business transfers, coordination of regional trademarkissues, labor and employment issues for Restaurant Support Center. ? Job Functions: ?Manage and prepare documentation relating to all aspects of franchisingfor KFC and Pizza Hut brands in Latin America and Caribbean. ?Undertake the negotiation, documentation and management of contractualrelationships with all franchisees across Latin America and Caribbean as wellas other third parties (e.g. suppliers). ?Manage and resolve contractual disputes and litigation. ?Provide the structure for the negotiation and management of businesssales and acquisitions. ?Maintain and update the Franchise Policies Manual and other manuals,policies and disclosure documents under the Franchising Code. ?Implement and monitor legal compliance programs. ?Approve Marketing and promotions material. ?Maintain external contractor screening and contract requirements. ?Assist global IP department with regional trademark issues. ?Support Human Resources function with employment law issues for officepersonnel. | |
J.D. from
accredited law school and US Bar required. 8+ years post
graduate experience is essential, preferably in major law firm or in-house
team. Specialised
knowledge in corporate and company law with specific knowledge of franchising,
intellectual property and trade practices law essential. Experience in licensing, sponsorships and
promotions will be highly regarded. Commercially
astute, solution oriented, able to generate creative options. Demonstrated
track record of strong negotiating performance. Self starter,
sense of urgency, able to work without close supervision. Excellent
written and verbal communication skills and ability to counsel and influence
other Departments, Franchise Partners and suppliers. Strong work
ethic. Ability to seek commercially viable solutions to
conflicts. Ability to juggle competing deadlines imposed by
different Departments. Fluency in written and verbal Spanish required;
Portuguese preferred. |
